1. Scope

1.1. The terms and conditions are applicable to transactions between the MS Lichttechnik GmbH and businesses and consumers (purchaser) 
1.2. The terms and conditions are completed as part of all our contracts with companies in the name of Austrian Commercial Code, as well as with consumers online via our webshop

2. Order – Contract

2.1. The customer's order is an offer. A contract comes to existence after an acceptance from our side, at the latest with the shipment of goods.
2.2. An order is only possible if all required fields, marked as * in the order form are filled. If there is missing information or we cannot fulfil the order for any other reason, the customer receives an error message. Before the final dispatch of the order, the customer is given the opportunity to correct his order.
2.3. Once the order process is complete, the customer will be notified about it in a popup window. However, this does not constitute an acceptance of the offer.
2.4. If the order is received, the customer will be informed about his or her designated e-mail address from the receipt of his order. This e-mail does not constitute acceptance of the offer. 
2.5. A contract exsists only after an acceptance of the order on our part. The customer will be notified of our acceptance by e-mail. 


3. Prices

3.1. All prices shown on the webshop lichtboxx.com are net prices exclusive of sales tax (VAT). Price corrections are expressly reserved, and can be performed at any time, this also applies to the correction of typographical errors.
3.2. The prices in Euros are ex warehouse including normal packaging and do not include shipping costs, taxes or any other fees incurred.
3.3. For all customers the minimum order value is €50 per order.


4. Delivery and payment

4.1. MS Lichttechnik GmbH provides deliveries usually by parcel service. The shipping costs will be borne by the buyer and are not included in the prices shown. You can find the current shipping costs in the delivery and shipping section.
4.2. If paying by cash, the respective current delivery fee is to offset. The delivery fee will be charged to the purchaser.
4.3. Delivered goods are owned by MS Lighting Technology GmbH until full payment 


5. Right of withdrawal

5.1. Customers who are consumers within the jurisdiction of the Austrian Consumer Protection Act may withdraw their orders, within a period of 14 calendar days from receipt of delivery of the goods ordered to a distance concluded.
5.2. The notice of withdrawal must be made in writing within the time limit without giving reasons. Saturdays, Sundays and public holidays include the calculation of the time limit. But in any case there are 7 working days available.
5.3. In case of cancellation a refund of the purchase price excluding shipping costs will be transferred with return of the delivered goods received by the buyer. Shipping cost for sending will only be assumed in case that products do not fit because of wrong description of products or false information of the customer before purchasing.
5.4. The goods must be returned unused, in condition like new and in original packaging.

5.6. Return Cost: The cost of the return delivery is to be borne by the consumer.                                                                                                                                        5.7 If customers are not consumers within the jurisdiction of the Austrian Consumer Protection Act, the right of withdrawal does not apply.

6. Privacy Information

6.1. We point out that the IP as well as the name and address of the purchaser are being saved for the purpose of easier shopping process and subsequent contract management from the webshop operator in the framework of cookies. A transfer of data to third parties does not apply except credit card number to the financial institution for the purpose of debiting the purchase price.
6.2. After completion of the virtual shopping, or after termination of the shopping process the data stored in the cookie is stored until the payment of the bill.
6.3. The data processing is based on the statutory provisions of § 96 para 3 of the Telecommunications Act and § 8 para 3 Data Privacy Act.


7. Statutory warranty - customer service

7.1. Performance for warranty claims is the headquarters of the seller. Requests to warranty claims can be sent to us by the following email address: office@lightspares.com
7.2 Used devices sold in our shop are checked and come with a 6 months warranty. In case of warranty claim the customer has to bring in the device and pick it up again after repair. (Bring-in guarantee)


8. Limitation of Liability

8.1. Claims for damages in cases of slight negligence are excluded. This does not apply to personal injury or damage to the handling of matters and product liability claims.
8.2. Claims for damages of the customer due to a defect shall expire one year from delivery of the goods. 


9. Place of execution - Jurisdiction 

Place of execution for our performance is Hirschstettner Strasse 19A, 1220 Vienna, jurisdiction is Vienna. Austrian law applies exclusively.
